Permit Requirement |
Imitation firearms are regulated by the Control of Weapons Act 1990. To display, possess, carry, use, import or sell an imitation firearm in Victoria, a Chief Commissioner of Police Prohibited Weapons Approval or a Governor in Council Exemption is required. |

NEW SOUTH WALES |

Permit Requirement |
You must complete the P634 'Application for a Firearms Permit' form AND the 'Imitation Firearm Legitimate Reason' or 'Imitation Firearm Permit Collector Legitimate Reason' form, and where applicable provide any supporting documentation. |

Permit Term and Fee |
The permit will be issued for a maximum term of 5 years and the prescribed fee for this permit is $75. |
Imitation Firearm Permit Application |
This permit is for persons wishing to possess or use an imitation firearm as defined by section 4D of the Firearms Act 1996. |
Imitation Firearm - Collector Permit Application |
This permit is for persons wishing to possess or use an imitation firearm as defined by section 4D of the Firearms Act 1996 for the purposes of maintaining imitation firearms in a collection or to display imitation firearms for educational, historical or commemorative purposes. |

Notes |
A replica weapon is a reasonable facsimile or copy of a weapon, even if it is not capable of discharging a projectile or substance, or a Category A, B or C weapon that has been rendered permanently inoperable or a hand grenade that is inert. |
WESTERN AUSTRALIA |

An ‘imitation’ firearm is a fake firearm that looks like the real thing but cannot be made to shoot. These are legal in Western Australia. |

Northern Territory |

Permit/License Requirement |
Under the Firearms Act NT, it is also illegal to be in possession of imitation firearms, such as gel blasters, airsoft, hydro blasters or gel ball firearms. Non-firing imitation firearms are prohibited under the Weapons Act NT. |

Australian Capital Territory (ACT) |

Permit Requirement |
According to the republication of the Firearms Act 1996 (including any amendment made under the Legislation Act 2001, part 11.3 (Editorial changes)) as in force on 30 March 2023—a replica of any firearm (including a replica pistol, blank fire pistol, paintball marker, shortened firearm, machine gun or submachine gun), unless it is of a type approved by the registrar, is a Prohibited Firearm. |
